Minister of Agriculture Regulation Number 13 of 2026 Applications for Genetically Engineered Feed Permits Must Now Include a Business Identification Number (NIB) and Introduce Rules on the Transfer of Certificates
Introduction
On 29 June 2026, the Ministry of Agriculture issued Minister of Agriculture Regulation Number 13 of 2026 on the Second Amendment to Minister of Agriculture Regulation Number 36/Permentan/LB.070/8/2016 concerning the Safety Assessment of Genetically Engineered Feed (“MOA Regulation 13/2026”), which took effect on 3 July 2026.
MOA Regulation 13/2026 enhances the governance and administrative efficiency of the licensing process, safety assessment, and issuance of safety certificates for Genetically Engineered Products (“GEP”) Feed in Indonesia. The Government has introduced these regulatory amendments to strengthen legal certainty for businesses while harmonizing licensing procedures with the latest organizational structure and working arrangements within the Ministry of Agriculture.

Key Provisions
Application Requirements
Applications for GEP Feed permits must be submitted to the Head of the Agricultural Assembly and Modernization Agency.
Pursuant to Article 6 paragraph (2), applicants are now required to attach a Business Identification Number (NIB) as part of the application process.
Meanwhile, applicants are no longer required to submit the Identity Card (Kartu Tanda Penduduk – “KTP”) of the company’s president director or authorized representative, which had previously been required under MOA Regulation 36/2016.
Delegation of Technical Formats to a Decree of the Head of the Agency
Article 7 paragraph (4) and Article 9 paragraph (3) delegate the detailed formats of application documents—including genetic information, feed safety information, and certificate formats—to be further regulated through a Decree of the Head of the Agricultural Assembly and Modernization Agency.
As a consequence of this amendment, all annexes to the previous Ministerial Regulations are no longer applicable.
New Mechanism for the Transfer of Certificate Ownership
Pursuant to Article 11A, ownership of a GEP Feed Safety Certificate may now be transferred.
Such transfer is permitted where:
· a business entity undergoes a merger, consolidation, or demerger;
· a higher education institution undergoes organizational changes; or
· a government institution undergoes restructuring through a merger, separation, and/or a change of nomenclature.
Applicants are required to submit legal documents evidencing the transfer, such as a notarial deed, together with a statement confirming that the relevant GEP Feed remains identical to the product previously assessed, and must also attach the GEP Feed Safety Certificate to be transferred.
Pursuant to Article 11B, the Head of the Agency must examine the completeness of the submitted documents within a maximum period of 14 days and is required to issue the amended certificate within 3 calendar days after the application has been declared complete and accurate.
Transitional Provisions
Applications for the safety assessment of GEP Feed that were submitted and remained under review before the entry into force of MOA Regulation 13/2026, namely before 3 July 2026, shall continue to be processed in accordance with MOA Regulation 34/2023.
However, the safety certificates for such applications shall be issued by the Head of the Agricultural Assembly and Modernization Agency on behalf of the Minister of Agriculture in accordance with the new regulatory framework.
Furthermore, all GEP Feed Safety Certificates issued under the previous regulations shall remain valid unless revoked or declared invalid in accordance with the applicable laws and regulations.

MOA Regulation 13/2026 represents an important step toward improving the governance of the safety assessment process for GEP Feed by strengthening legal certainty, simplifying administrative procedures, and harmonizing the regulatory framework with Indonesia’s Risk-Based Business Licensing system.
These amendments introduce the mandatory submission of a Business Identification Number (NIB), delegate technical regulatory matters to the Head of the Agricultural Assembly and Modernization Agency, and establish a legal mechanism governing the transfer of GEP Feed Safety Certificates.
For businesses, MOA Regulation 13/2026 requires adjustments to administrative requirements and licensing procedures, particularly in relation to permit applications and changes to corporate structures. The transitional provisions also provide legal certainty by recognizing the continued validity of certificates previously issued and ensuring that applications submitted before 3 July 2026 will continue to be processed under MOA Regulation 34/2023.
