OJK Regulates Incidental Reporting in the Capital Market, Derivatives Finance, and Carbon Exchange Sectors through PADK 8/2026
Introduction
On 4 August 2026, the Financial Services Authority (Otoritas Jasa Keuangan) issued Regulation of the Members of the Board of Commissioners of the Financial Services Authority Number 8 of 2026 concerning Guidelines for Incidental Reporting through the Financial Services Authority Reporting System in the Capital Market, Derivatives Finance, and Carbon Exchange Sectors (“PADK 8/2026”), which took effect on 1 October 2026. PADK 8/2026 constitutes an implementing regulation of Financial Services Authority Regulation Number 9 of 2026 concerning Incidental Reporting through the Financial Services Authority Reporting System in the Capital Market, Derivatives Finance, and Carbon Exchange Sectors (“POJK 9/2026”), which provides technical guidelines on the procedures, formats, and mechanisms for submitting incidental reports online through the OJK Reporting System. PADK 8/2026 also establishes more standardized references regarding the classification of report types, reporting codes, and data-entry formats for parties required to submit incidental reports to OJK outside the periodic reporting mechanism.
Key Provisions
- Scope and Structure of the Regulation
As stipulated in Article 1 of PADK 8/2026, the guidelines for incidental reporting in the capital market, derivatives finance, and carbon exchange sectors are set forth in three annexes, which constitute an integral and inseparable part of PADK 8/2026, as follows:

Annex I contains general guidelines for the submission of Incidental Reports through the OJK Reporting System by Reporting Parties;

Annex II contains a list of Incidental Reports to be submitted by Reporting Parties; and
-
Annex III contains the format and procedures for preparing Incidental Reports.

- Classification of Reporting Parties
Roman numeral II of Annex I classifies Reporting Parties into six major categories, each of which has different reporting obligations:

Securities Institutions, comprising stock exchanges, clearing and guarantee institutions, central securities depositories and settlement institutions, market operators, alternative market operators, securities financing institutions, securities pricing agencies, investor protection fund operators, and customer due diligence administration service providers (LAPMN);

Securities Companies, namely holders of licenses as securities underwriters/securities brokers, or investment managers;
-
Supporting Institutions, comprising investment advisers in the form of companies (mutual fund rating providers and investment managers), custodian banks, and trustees;

Supporting Professions, namely public accountants;

Boards of Directors and/or Boards of Commissioners of Reporting Parties in the first through third groups, particularly securities companies conducting business as securities underwriters or securities brokers; and

Other Parties, including crowdfunding service providers, issuers of participation-form asset-backed securities, and other parties required by OJK to submit Incidental Reports.

- Mechanism and Means of Submitting Reports
As stipulated in Roman numeral III of Annex I, Reporting Parties are required to submit Incidental Reports and/or corrections thereto online through the OJK Reporting System, which may be accessed through the website https://pelaporan.id or another address designated by OJK. All documents and data stored in this system have the same legal force as printed documents, an important provision as it confirms the legal validity of electronic reporting. Reporting Parties may also submit several types of Incidental Reports simultaneously in a single submission, including reports relating to different dates of occurrence and more than one row of data for each type of report.
- Types and Deadlines for Incidental Reports
Annex II of PADK 8/2026 contains 75 types of Incidental Reports that must be submitted by various categories of Reporting Parties in the capital market, derivatives finance, and carbon exchange sectors. These types of reports cover reports relating to General Meetings of Shareholders (RUPS), changes to or disruptions of systems, special events, financial distress, suspected violations, policy changes, and the implementation of measures to resolve conditions that may endanger business continuity.
PADK 8/2026 stipulates that Incidental Reports shall be submitted online through the OJK Reporting System and are not subject to any specific reporting period; reports shall be submitted from time to time in accordance with the deadlines stipulated in laws and regulations or in an OJK notification.
- Technical Reporting Format
Chapter I and Chapter II of Annex III stipulate that each Incidental Report consists of two mandatory forms:

Form 01.00 (Main Information), prepared in the form of a text file (.txt)
Contains 27 data columns, including, among others: reporting code, date of occurrence, number and date of the OJK decision letter, identity of the principal party/shareholder, type and name of product/activity, description/reason, remedial measures, target completion date, realization, and completion status. Each type of report has a unique reporting code corresponding to the Reporting Party group, beginning with the codes LE (Securities Institutions), PE (Securities Companies), LP (Supporting Institutions), PP (Supporting Professions), DK (Boards of Directors/Boards of Commissioners), and LL (Other Parties), which determine which columns are mandatory, as mapped in the matrix in Chapter III of Annex III. For each type of report and each date of occurrence, the Reporting Party must prepare a separate PDF document as a Supporting Document. -
Form 02.00 (Supporting Document), prepared in PDF format.
This document is used to supplement the information submitted through Form 01.00. For each type of report and each date of occurrence, the Reporting Party must prepare one supporting document in PDF format.

- Report Correction Mechanism
Roman numeral III point 3 letters d and e of Annex III regulate errors in data and/or information in the completion of Incidental Reports, including failure to submit data, information, and/or supporting documents. Such conditions include:

entering data and/or information that does not correspond to the actual circumstances;

failing to complete the Incidental Report; and/or
-
failing to complete the supporting documents.

In the event of an error in the data and/or information in an Incidental Report that has already been submitted, the Reporting Party may only submit a correction after the deadline for submitting the Incidental Report has expired and the Reporting Party has received a notification from OJK accompanied by a correction letter number.
Closing
PADK 8/2026 provides more structured technical guidelines for Reporting Parties in fulfilling their obligation to submit Incidental Reports to OJK. By regulating the classification of Reporting Parties, 75 types of Incidental Reports, submission deadlines, data and supporting document formats, and the correction mechanism, this regulation provides clearer and more uniform standards for the implementation of reporting through the OJK Reporting System. Therefore, Reporting Parties need to ensure that the type of report, reporting code, data and supporting documents, as well as the submission deadline, comply with the applicable provisions for each Incidental Report.
