Minister of Immigration and Corrections Regulation Number 10 of 2026 Expands the List of Indonesian Visa-Free Visit Beneficiaries

Introduction

On 7 July 2026, the Ministry of Immigration and Corrections issued Minister of Immigration and Corrections Regulation Number 10 of 2026 on the Expansion of the List of Countries, Special Administrative Region Governments of a Country, and Certain Entities Granted Visa-Free Visit Facilities (“MOIC Regulation 10/2026”), which took effect on 9 July 2026.

MOIC Regulation 10/2026 expands the categories of foreign nationals eligible to receive immigration facilities in the form of Visa-Free Visits (Bebas Visa Kunjungan – “BVK”), namely permission to enter the territory of the Republic of Indonesia without the requirement to obtain a visa, for the purpose of undertaking visits in accordance with the prevailing laws and regulations.

The expansion of the list of beneficiaries of the Visa-Free Visit facility is based on the Government’s commitment to promoting the growth of the tourism sector, increasing investment and economic activities, and strengthening diplomatic relations based on the principle of reciprocity, while continuing to take into account national defense and security interests.

In line with this policy, MOIC Regulation 10/2026 revokes and declares no longer effective Minister of Immigration and Corrections Regulation Number 10 of 2025 on the Expansion of the List of Countries, Special Administrative Region Governments of a Country, Certain Entities, or Holders of Certain Residence Permits of a Country Granted Visa-Free Visit Facilities (“MOIC Regulation 10/2025”).

Comparison

MOIC Regulation 10/2026 regulates substantially the same subject matter as MOIC Regulation 10/2025 but introduces several fundamental changes.

The first difference lies in its title and scope. MOIC Regulation 10/2026 removes the phrase “or Holders of Certain Residence Permits of a Country”, which was previously included in MOIC Regulation 10/2025. The removal of this phrase narrows the scope of persons eligible to receive the Visa-Free Visit (BVK) facility.

Under MOIC Regulation 10/2026, eligibility for the Visa-Free Visit facility is now determined entirely based on nationality or the designated country, special administrative region government, or certain entity, and no longer takes into account an individual’s residence permit status in another country as a basis for granting the facility.

For example, nationals of countries that are not included in the list of Visa-Free Visit beneficiaries remain ineligible for the facility even if they hold permanent resident status in a country or territory included in the list of Visa-Free Visit beneficiaries. Accordingly, residence permit status in a third country no longer serves as a basis for obtaining Visa-Free Visit facilities to Indonesia.

Consequently, the Visa-Free Visit facility is granted only to nationals of countries, special administrative region governments, or certain entities expressly listed in the Annex to MOIC Regulation 10/2026. This approach provides greater legal certainty, simplifies the evaluation mechanism for the list of Visa-Free Visit beneficiaries, and strengthens immigration supervision based on nationality parameters established by the Government.

The second difference concerns the Annex containing the list of Visa-Free Visit beneficiaries. MOIC Regulation 10/2026 expands the list to six countries and territories by adding the Republic of Kazakhstan, the Macau Special Administrative Region of the People’s Republic of China, and the Republic of Belarus, in addition to the three countries previously regulated under MOIC Regulation 10/2025, namely Türkiye, Brazil, and Peru.

In determining such eligibility, the Minister is required to consider several key indicators, including:

·      the principle of reciprocity;

·      the principle of benefit;

·      national security;

·      tourism potential;

·      economic and investment impacts; and

·      other strategic policy considerations as may be determined directly by the President.

Updated List of Beneficiary Countries and Entities

Pursuant to Article 3 paragraph (2), the Government sets out the detailed list of beneficiaries in the Annex, which forms an integral and inseparable part of the Ministerial Regulation.

The Visa-Free Visit facility is now lawfully granted to nationals of the following six (6) countries and special administrative region entities:

·      Republic of Türkiye;

·      Federative Republic of Brazil;

·      Republic of Peru;

·      Republic of Kazakhstan;

·      Macau Special Administrative Region of the People’s Republic of China; and

·      Republic of Belarus.

MOIC Regulation 10/2026 expands the scope of Visa-Free Visit beneficiaries as part of the Government’s efforts to enhance the competitiveness of Indonesia’s tourism sector, strengthen diplomatic relations, and promote investment and national economic growth.

Based on a mechanism of periodic evaluation and inter-ministerial coordination, taking into account the principles of reciprocity and benefit, as well as national defense and security interests, the Government has designated six (6) countries and territories to receive Visa-Free Visit facilities, namely the Republic of Türkiye, the Federative Republic of Brazil, the Republic of Peru, the Republic of Kazakhstan, the Macau Special Administrative Region of the People’s Republic of China, and the Republic of Belarus.
