BPJPH Regulation 4/2026 Requires Imported Products to Undergo a Halal Product Assurance Process

Introduction

On 7 August 2026, the Head of the Halal Product Assurance Organizing Agency (“BPJPH”) issued Regulation of the Halal Product Assurance Organizing Agency of the Republic of Indonesia Number 4 of 2026 on Assurance of Conformity of Foreign Halal Products Entering the Territory of Indonesia (“BPJPH Regulation 4/2026”). BPJPH Regulation 4/2026 was issued to serve as a guideline for implementing the assurance of conformity of foreign halal products entering the territory of Indonesia. In particular, BPJPH Regulation 4/2026 regulates the obligation to ensure the conformity of foreign halal products, the appointment of inspection bodies, application procedures, and the integration of customs reporting through the Indonesia National Single Window System (SINSW).

The establishment of BPJPH Regulation 4/2026 was prompted by the need to ensure the conformity of foreign halal products with the provisions governing halal product assurance in Indonesia. BPJPH Regulation 4/2026 provides a legal basis for business actors to ensure that imported products have satisfied halal requirements before entering and being distributed within the territory of Indonesia. Through these provisions, conformity assurance is conducted with respect to product documents and physical conditions in the country of origin, thereby enabling the entry, distribution, and trade of foreign halal products to be carried out in a more structured manner and providing certainty for both business actors and consumers.

Key Provisions

• Halal Product Assurance Obligation and Product Exemptions

As stipulated in Article 2, every product entering, circulating, and being traded within the territory of Indonesia must be halal-certified in accordance with the provisions of laws and regulations. Products originating from prohibited materials are exempt from the halal certification obligation but must bear a Non-Halal Statement. Both products that are subject to the halal certification obligation and products that are exempt therefrom must undergo Halal Product Assurance prior to the submission of the Import customs declaration.

The obligation to undergo Halal Product Assurance does not apply to passengers’ personal belongings, personal belongings of transport means crew members, personal consignments, consignments of Indonesian migrant workers, border-crossing goods, household goods belonging to Indonesian and foreign nationals relocating to Indonesia, consignments of Hajj pilgrims through postal operators, samples for testing, transit/transshipment goods, and/or other goods in accordance with the provisions of laws and regulations.

• Physical Verification in the Country of Origin and Role of Inspection Bodies

Based on Articles 3 through 7, Halal Product Assurance is carried out by BPJPH by appointing state-owned Inspection Bodies and/or private Inspection Bodies that satisfy the applicable requirements. The principal requirements for Inspection Bodies that may be appointed include:

Inspection Bodies that satisfy these requirements shall submit an application to BPJPH through the Integrated Electronic System. BPJPH shall verify the documents and, if necessary, may conduct a field inspection. If the documents are declared complete and compliant, the Head of the Agency shall designate the Inspection Body as the implementer of Halal Product Assurance and determine its area of operation based on its overseas branch offices and Inspection Body partners.

Furthermore, Halal Product Assurance shall be conducted in the country of loading and/or the country of origin of the product after the Importer submits an application to the Head of BPJPH. Such activity must be conducted directly at the goods loading warehouse prior to shipment and shall include an examination of the conformity of the SJPH requirement documents with the physical condition of the products.

The results of the Halal Product Assurance shall be set out in a Halal Product Assurance Report (LPPH), which shall be submitted by the Inspection Body to the Head of the Agency through the Integrated Electronic System. The LPPH shall contain information regarding the conformity or non-conformity of the results of the Halal Product Assurance.

• Halal Product Assurance Application Mechanism 

As stipulated in Article 8, the Importer must submit an application for Halal Product Assurance through the Integrated Electronic System and select an Inspection Body designated by BPJPH. To submit the application, the Importer must satisfy a number of administrative requirements and provide supporting documents, including:

BPJPH Regulation 4/2026 introduces a mechanism for assuring the conformity of foreign halal products that is carried out before the products enter the territory of Indonesia. This regulation strengthens the supervision process by establishing the examination of product documents and physical conditions in the country of loading and/or the country of origin as an important step prior to shipment, and by involving Inspection Bodies designated by BPJPH.

For Importers, BPJPH Regulation 4/2026 emphasizes the importance of preparing the required documents and satisfying the applicable requirements before submitting an Import customs declaration. Importers should also pay attention to the obligation to apply for Halal Product Assurance through the Integrated Electronic System, select an Inspection Body designated by BPJPH, and ensure the consistency of the information contained in the documents with the physical condition of the products.
