Regulation of the National Nutrition Agency Number 1 of 2026 Mandates SPPG to Manage Food Residues and Waste from the MBG Program

Introduction

On 11 February 2026, the National Nutrition Agency (“BGN”) issued Regulation of the National Nutrition Agency Number 1 of 2026 on Food Residues, Waste, and Domestic Wastewater from the Free Nutritious Meal Program (“BGN Regulation 1/2026”), which took effect on 17 March 2026. This regulation mandates Nutrition Fulfillment Service Units (“SPPG”) to handle all material discharges arising from the implementation of the Free Nutritious Meal Program (“MBG”) in the field.

BGN Regulation 1/2026 is established to safeguard public health and prevent potential environmental pollution resulting from the implementation of this national-scale program. It also aims to support the application of food hygiene and sanitation principles within the MBG program, while serving as an implementing regulation of Article 39 paragraph (4) of Presidential Regulation Number 115 of 2025 on the Governance of the Free Nutritious Meal Program. Through this regulation, BGN seeks to address domestic waste challenges and prevent waste generation from the food production stage in kitchens through to post-consumption by target groups.

 

Key Provisions

Obligations of SPPG and Provision of Facilities and Infrastructure

Pursuant to Article 2 paragraph (1), each SPPG is required to carry out the handling of food residues, waste management, and domestic wastewater management. Article 14 paragraphs (1) and (2) require SPPG to provide various facilities and infrastructure to support these obligations, including:

  1. Containers for the collection of food residues and waste sorting containers; 
  2. Supporting facilities for preventing food residues, composting facilities, and transportation facilities; 
  3. Hygiene and sanitation facilities, as well as domestic wastewater treatment facilities; and 
  4. Temporary storage facilities and personal protective equipment (PPE) for personnel.

Article 3 paragraph (2) stipulates that SPPG is required to carry out prevention, data collection, and rescue of food residues, both at SPPG locations and within target groups. In the event of excess food production, undistributed food, or force majeure circumstances, Article 7 paragraphs (2) and (3) provide that SPPG may rescue such food by distributing it to the local community, provided that it meets feasibility and safety standards. Furthermore, pursuant to Article 6 paragraph (8), SPPG is required to conduct data collection in accordance with the format set out in the Annex, which separates waste volume based on carbohydrate sources, protein, vegetables, and fruits in kilograms. SPPG is also required to measure beneficiary satisfaction through a menu evaluation questionnaire assessing appearance, taste, texture, and aroma. All results of these food rescue efforts must be reported by SPPG through the electronic platform “Stop Food Waste” in accordance with Article 8 paragraph (2).

Waste Management Based on Circular Economy Principles

Pursuant to Article 10 paragraph (2), SPPG is required to manage all generated waste by applying circular economy principles. The management mechanism involves a series of reduction and handling efforts, including waste sorting into four main categories as classified under Article 11 paragraph (1), namely organic waste, inorganic waste, residual waste, and waste containing Hazardous and Toxic Substances (B3). SPPG is required to record the volume of such management and submit it in reports to the regional government in accordance with Article 10 paragraphs (6) and (7).

Domestic Wastewater Control

Article 13 paragraph (4) provides SPPG with the option to treat its domestic wastewater independently or to assign such treatment to a third party. Where SPPG chooses to discharge treated wastewater into environmental channels, Article 13 paragraph (6) requires SPPG to operate and maintain domestic wastewater treatment units, determine compliance points for treated domestic wastewater, ensure that discharge flows to drainage channels are not obstructed, and monitor domestic wastewater at such compliance points every 3 (three) months.

 

Sanctions

Article 17 stipulates the imposition of administrative sanctions on SPPG that fail to carry out the handling of food residues, waste management, and domestic wastewater management. The sanctions may take the form of written warnings, temporary suspension of operations, and/or permanent termination.

 

Closing

BGN Regulation 1/2026 mandates SPPG to manage food residues, waste, and domestic wastewater from the MBG Program in order to safeguard public health and prevent environmental pollution. SPPG is required to provide supporting facilities and infrastructure to rescue and record food residues, implement waste management based on circular economy principles, and control domestic wastewater through periodic monitoring. Non-compliant SPPG will be subject to administrative sanctions, ranging from written warnings to permanent termination of operations.
