Summary

The Regulation of the Nuclear Energy Regulatory Agency (BAPETEN) Number 3 of 2025 concerning the 2025-2029 Strategic Plan of the Nuclear Energy Regulatory Agency (“Regulation 3/2025”) was issued and took effect upon its promulgation on October 10, 2025.

The purpose of this regulation is to operationalize the 2025-2029 National Medium-Term Development Plan through policies, programs, and activities in the field of nuclear energy oversight, and to serve as a reference for the Agency’s budget planning and allocation.

Background and Context

This regulation was issued pursuant to the mandate of Law Number 25 of 2004 concerning the National Development Planning System, which requires every ministry or agency to prepare a Strategic Plan that aligns with the RPJMN.

The 2025-2029 BAPETEN Strategic Plan was formulated to address the challenges and opportunities in nuclear energy utilization, which has become increasingly vital to the national development agenda. It plays a key role in supporting economic transformation, energy security, and improved health services, as mandated by the 2025-2045 National Long-Term Development Plan.

This regulation is necessary to ensure that all of BAPETEN’s supervisory functions through regulation, licensing, and inspection can be implemented in a structured, measurable, and effective manner to safeguard the safe utilization of nuclear energy, particularly given the national strategic agenda for preparing the development of Nuclear Power Plants.

  4. Enhancement of the national system for environmental monitoring, nuclear security, and preparedness; and
  5. Implementation of sustainable bureaucratic reform.

Priority Thematic Areas

BAPETEN’s programs and activities focus on four thematic priorities:

  1. Energy: Supporting oversight preparation for NPP development, including regulatory and institutional readiness, design review, and site evaluation.
  2. Health: Supporting the independence of the radiation-based medical device industry (X-ray machines, radiopharmaceuticals) and improving the quality of medical services.
  3. Environment: Strengthening oversight of radioactive waste management and the management of Naturally Occurring Radioactive Materials (NORM) from the mining industry.
  4. Science and Technology: Coordinating the national nuclear security and preparedness system through the I-CONSEP platform and expanding the radiation detection network (I-RDMS).

Roles and Opportunities for Business Actors

The Strategic Plan outlines expanded roles for the private sector and identifies investment opportunities, including:

  1. Energy Sector: Business actors may participate as NPP owners/operators (through SOE, PPP, or private schemes), as part of the construction and manufacturing supply chain, or as providers of supporting services (Technical Support Organization/TSO).
  2. Health and Industrial Sectors: Encouraging investment in the production of radiation-based medical devices (KBLI 26601) and radioisotope production (KBLI 32906) to reduce import dependency.
  3. New Opportunities: The Job Creation Law opens access for business actors to enter previously restricted fields, such as nuclear mineral mining, radioactive waste management, and research and development facilities.

Regulatory Framework BAPETEN plans to draft and revise a number of regulations over the next five years. The priority agenda includes the Bill [Rancangan Undang-Undang (RUU)] to Amend the Nuclear Energy Law, Government Regulations on Nuclear Installations and on Nuclear Security, and a series of Agency Regulations covering technical details on NPP oversight, radiation safety, and human resource competency standards. Institutional Framework BAPETEN will strengthen its organizational structure, including through bureaucratic simplification and the development of more adaptive and responsive work mechanisms. Performance Targets and Funding Framework The Strategic Plan sets measurable quantitative performance targets for each strategic objective, program, and activity. Funding requirements for achieving these targets are projected for the 2025-2029 period, primarily sourced from the State Budget (APBN) and Non-Tax State Revenue. Digital Planning System Integration Performance data and information under BAPETEN’s Strategic Plan as recorded in the KRISNA-RENSTRAKL Information System (the national planning and budgeting platform) are declared an integral part of the Strategic Plan. This provision affirms BAPETEN’s obligation to ensure alignment between its strategic planning and the central government’s digital budgeting and reporting system. Article 3

  2. Industrial Independence: A focus on strengthening the self-sufficiency of the national radiation-based medical device industry, which could reduce import dependency and drive domestic innovation in the health sector.

  3. Digital Integration: The enhancement of an integrated, digital-based oversight system (through the BALIS and I-RDMS platforms) to improve regulatory effectiveness and ensure service certainty for users.
