Peraturan ini mencabut: 1. Peraturan Daerah Kota Probolinggo Nomor 5 Tahun 2015 tentang Pengelolaan Drainase Perkotaan (Lembaran Daerah Kota Probolinggo Tahun 2015 Nomor 5, Tambahan Lembaran Daerah Kota Probolinggo Nomor 17).

Peraturan Daerah Kota Probolinggo Nomor 2 Tahun 2016 ini dibentuk dengan tujuan untuk mencabut Peraturan Daerah Kota Probolinggo Nomor 5 Tahun 2015 tentang Pengelolaan Drainase Perkotaan. Latar belakang pencabutan ini adalah Putusan Mahkamah Konstitusi Nomor 85/PUU-XI/2013 yang membatalkan Undang-Undang Nomor 7 Tahun 2004 tentang Sumber Daya Air, yang menjadi landasan hukum bagi Perda Nomor 5 Tahun 2015 tersebut. Dengan dibatalkannya UU No. 7 Tahun 2004, maka Perda Kota Probolinggo Nomor 5 Tahun 2015 kehilangan kekuatan hukum mengikat dan perlu dicabut. Pasal 1 Perda ini secara eksplisit mencabut Perda Nomor 5 Tahun 2015, dan Pasal 2 menetapkan bahwa Perda ini mulai berlaku pada tanggal diundangkan.
